FLSA UPDATE!! The Overtime Rule Has Been Blocked. A Federal Judge in Sherman, Texas, blocked a Labor Department rule that would have expanded overtime protections to more workers as of Dec. 1, 2016.
U.S. District Judge Amos Mazzant issued a nationwide preliminary injunction against the rule, which he said improperly creates a salary test to determine who is protected by the Fair Labor Standards Act’s “white collar” exemption.
Tuesday’s ruling delays implementation of the U.S. Department of Labor’s (DOL) new regulations which would have increased the number of employees entitled to overtime pay. The court’s decision calls into question whether these proposed overtime changes ever will go into effect.
